Welcome to FoneRecharge!  The FoneRecharge website (www.fonerecharge.com) and service (accessible through this website and by telephone) is owned and operated by FoneRecharge LLC.  The FoneRecharge website and FoneRecharge's services, which are also provided by telephone, are collectively referred to as "FoneRecharge", "us" or "we".

These Terms describe the legal framework in which you use this website and the FoneRecharge service.

 

Eligibility to Use FoneRecharge

Use of FoneRecharge is only permitted providing you represent and warrant that (a) all information you submit is truthful and accurate, including that the email address you submit is one that you own and use, and the credit card details you provide are for a credit facility that is rightfully yours to operate; (b) you will maintain the accuracy of such information; (c) you are 18 years of age or older;  and (d) that your use of FoneRecharge does not violate any applicable law or regulation.  

 

Your FoneRecharge Account

By using FoneRecharge, you agree to maintain the confidentiality of your account, password and PIN and understand that you are responsible for any activity occurring under your account by any person using your password and/or PIN.  You must keep your account information current.  You must ensure that your Thuraya sim card is active that your Thuraya number is correct.  We can not refund any recharge units that have been added to an incorrect Thuraya prepaid account.

If you access FoneRecharge on a computer that others may access, you should ensure that you log out from your account at the end of each session.

You also understand that FoneRecharge reserves the right to refuse, block or cancel any account at its sole discretion.

 

Privacy

The use of FoneRecharge is also governed by our Privacy Policy, which you can access by clicking here.

 

FoneRecharge Content

All content on this site is the property of FoneRecharge and is protected international law, including, but not limited to all graphics, code and software incorporated into, used on, or offered via this site, service and trade marks.  You may view the site and may print pages of the site solely in relation to your use of the site.  Otherwise you may not reproduce, modify, distribute, create derivative works of, publicly display or in any way exploit, any of the content, software, or materials available on the FoneRecharge website or any other FoneRecharge materials, in whole or in part without the express written permission of FoneRecharge.

 

Trademarks and Copyright

FoneRechargeTM and the FoneRecharge Logo are trademarks of FoneRecharge.  These must not be used with the prior, written consent from FoneRecharge.

All content on FoneRecharge, including, but not limited to, text, photographs, graphics, audio, and video content, as well as the website itself, is protected by copyright and is the property of FoneRecharge.

 

No Warranty

To the extent permitted by applicable law, the FoneRecharge website and service is provided on an "as is" basis without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.  If applicable law requires a warranty, the required warranty is limited to ninety (90) days from your first use of this site.

This site and any email we send may contain viruses or other harmful components.  Use of this site and the FoneRecharge service is at your risk.

 

Limitation of Liability

Unless and to the extent applicable law prohibits this limitation, FoneRecharge is not liable to you for any consequential, special, incidental, or indirect damages of any kind arising out of your use of this website, the FoneRecharge service, any email sent by FoneRecharge, or your purchase of or use of a product or service offered via the site, even if FoneRecharge has been advised of the possibility of such damages.  Unless and to the extent applicable law prohibits this limitation, FoneRecharge's liability for any claim related to your use of the site or any email sent by FoneRecharge, or your purchase of or use of a product or service offered via the site, whether in contract, tort, or any other theory of liability will not exceed the greater of the amount you paid for the product or service, or US$5.00.

 

Title, Risk of Loss

Title and the risk of loss for any tangible item that you purchase from FoneRecharge passes to you upon FoneRecharge's delivery to its carrier.

 

Applicable Law

These Terms shall be governed by the laws of the state of Massachusetts, excluding it's conflicts of law provisions, and the laws of the United States of America as applicable.  You agree to submit to the jurisdiction of courts sitting in the State of Massachusetts for all purposes.  Sole and exclusive venue for any dispute arising under or relating to this agreement shall be in a court sitting in Massachusetts, USA.

FoneRecharge is administered in the USA and any use outside of the USA is at the user's own risk.  Users are responsible for compliance with any additional local laws applicable to their use of the FoneRecharge website or services.

 

Changes to Terms

From time to time, we may need to change these terms to reflect our changing business (or if required by law, or for security, technical or other reasons).  You agree and understand that these Terms, the FoneRecharge website, and any aspect of FoneRecharge's services may be modified by FoneRecharge at any time, without prior notice, and such modifications will be effective upon FoneRecharge's posting of the new Terms and/or upon implementation of the changes on the FoneRecharge website or service.  You agree to review the Terms periodically so that you are aware of any modifications.  Your continued use of FoneRecharge after any modifications indicates your acceptance of the modified Terms.  Unless expressly stated otherwise by FoneRecharge, any new features, new services, enhancements or modifications to FoneRecharge implemented after your initial access shall be subject to these Terms.  You also understand that the FoneRecharge website may contain errors or may not be complete or current, including errors as to pricing and availability.  We reserve the right to refuse in good faith to process any order based on errors as to pricing, availability or other material facts.

 

Miscellaneous

These Terms, accepted upon use of the FoneRecharge website and/or FoneRecharge services, and all terms, guidelines and rules referenced herein, contain the entire agreement between you and FoneRecharge regarding the FoneRecharge website and/or FoneRecharge services. The failure of FoneRecharge to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.  If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in fully enforceable. These Terms are not assignable, transferable or sub-licensable except with FoneRecharge's prior written consent. The section titles in these Terms are for convenience only and have no legal or contractual effect.
